 General

 1. FlyTandem GmbH & Co KG (hereinafter referred to as " FlyTandem ") organizes tandem paragliding flights. The flights are carried out by independent tandem pilots. The organizer and contractual partner is the company indicated on the flight ticket. This flight ticket, which must be completed in full before the tandem flight begins, also serves as an invoice for the service provided.
 
 2. FlyTandem assumes liability for the careful selection of a suitable and safety-conscious tandem pilot. However, no liability is assumed for the performance of the tandem flight itself.
 
 3. The transport of persons in tandem paragliders and all other services provided by FlyTandem are subject exclusively to Austrian law, in particular the provisions of the Aviation Act, as well as the following conditions.
 
 4. Before starting the flight, the passenger (in the case of children, a legal guardian or an adult accompanying person) is obliged to read the transport contract carefully and confirm it with his or her signature. Immediately before take-off, the pilot will provide instructions on the take-off procedures. If the passenger does not understand these instructions or is unable to follow the instructions for any reason, the pilot must be informed immediately.
 
 
 
 Insurance and liability limitations
 
5. FlyTandem or the tandem pilot is only liable for damages if the damage was caused by an intentional or grossly negligent act or omission by FlyTandem, its employees, or persons engaged to fulfill the transport contract. Liability is excluded if the carrier and its agents have taken all reasonable and necessary measures to prevent the damage, or if such measures could not be taken. The carrier’s liability for items carried along by the tandem passenger is limited to the amount covered by the liability insurance taken out for this purpose. Any further claims can only be made in cases of intent or gross negligence.
 
 6. The passenger is solely responsible for the shockproof packaging of any photo and video equipment as well as other valuables brought along. These items must be secured in such a way that loss during the flight is ruled out.
 It is not permitted to bring sharp, pointed, or glass objects, weapons, pressurized containers, explosives, ignition devices, or pyrotechnic flares on the flight.

 7. FlyTandem accepts no liability for damages incurred on the way to the launch site or from the landing site.
 
 8. The exclusions and limitations of liability also apply accordingly to the benefit of FlyTandem’s employees, independent tandem pilots, and authorized agents.
 
 
 Obligation to report health impairments
 
 9. The passenger is obliged to inform FlyTandem and the tandem pilot in good time about health conditions that could pose an increased risk to him. This includes in particular limitations in mobility, which can increase the risk of injury during take-off or landing.
 
 10. The following must be reported in all cases: - serious accidents within the last 12 months - limitations of the musculoskeletal system - serious diseases of the heart, spine, intervertebral discs or organs, as well as high blood pressure or similar complaints that require or have required medical treatment - psychological or mental impairments such as drug addiction, impaired consciousness or similar within the last 12 months or on an ongoing basis - consumption of alcohol within the last 12 hours before the flight.
 
11. If there is any uncertainty regarding flight fitness, the passenger is obliged to consult FlyTandem and the performing pilot about their suitability. 
 
 
 
 Equipment
 
12. The passenger agrees to wear appropriate clothing (weather- and windproof, suitable for getting dirty), sturdy footwear if possible (covering the ankles), and gloves. A helmet and flight equipment will be provided. 
 
 
 
 Dates and implementation
 
 13. FlyTandem organizes tandem flights all year round. Restrictions may arise due to weather conditions and the operating times of the mountain railways in the respective flight areas. An online booking system is available for reserving appointments. Additional appointments can be requested and arranged using a form on the website, by phone or by email. FlyTandem is happy to help passengers select the flight area and the optimal time. 
 
 14. We expressly point out that, despite firmly agreed dates, there is no entitlement to the tandem flight being carried out if the weather conditions in the flight area do not permit this. In the event of postponements or short-term cancellations, there is no entitlement to compensation, reimbursement or reimbursement of other expenses incurred. However, the right to reschedule the flight remains. FlyTandem always endeavours to inform passengers as soon as possible about the feasibility of the flight. 
 
 15. Cancellations due to weather conditions do not require objective evidence. The subjective impression of the responsible pilot is sufficient to cancel the flight. 
 
 16. The duration of the flight depends on various weather conditions, which is why no uniform or guaranteed flight time can be guaranteed. 
 
 17. The passenger is obliged to fully follow the pilot's instructions throughout the flight, as well as during take-off and landing. 
 
 
vouchers
 
 18. Two types of vouchers are offered: Tandem Flight Voucher:  A voucher for a specific flight offer. Value Voucher: A voucher issued for a specific monetary amount.  Both types of vouchers are considered multi-purpose vouchers. The tandem flight voucher also represents only a preliminary selection. Until an appointment is scheduled, a different offer can be selected in the customer area, and the amount paid as stated on the voucher will be credited toward the new selection. If the value of the selected offer exceeds the amount of the value voucher, the customer must pay the difference. If the value of the selected offer is less than the voucher amount, the remaining balance will remain on the voucher. This remaining credit can be checked online in the customer area using the voucher code.   
 
19. Validity: The paid value of the voucher is secured for 30 years. For tandem flight vouchers, there is an additional price guarantee for the preselected offer valid for 1 year from the date of issue. After this period, when booking, any difference between the current price of the selected offer and the paid value indicated on the voucher must be covered.
Note: The voucher value indicated on vouchers issued as part of discounts or marketing campaigns also applies for the price guarantee and extension.
 
20. Vouchers are freely transferable. However, it is the responsibility of the voucher holder to ensure that the person to whom the voucher is transferred meets the participation requirements. A cash payout of the voucher value is excluded.


Vouchers from sales partners
 
21. FlyTandem accepts vouchers from selected distribution partners. It is the passenger’s responsibility to verify the validity of the voucher. If a voucher is invalid (e.g., due to the insolvency of the distribution partner), FlyTandem is entitled to charge the passenger the full flight price.


Right of withdrawal for vouchers

22. In accordance with the provisions of the Consumer Protection Act (KSchG), the purchaser has the right to withdraw from the purchase without stating any reasons within 14 days of receiving the voucher. To exercise the right of withdrawal, it is sufficient to return the voucher within this period.

23. For a ticket, the flight date is already fixed. 

24. The right of withdrawal and exchange is excluded for tickets within the cancellation periods. However, if a change of date or flight area is desired within the cancellation periods, we will make every effort to accommodate this change request within our organizational capabilities. If the flight cannot take place due to force majeure, particularly unfavorable weather conditions, there is the option to convert the ticket into a voucher free of charge. This voucher entitles the holder to choose another offer from our range at a later date. If no new appointment or suitable offer can be found, the ticket value may be refunded at the customer’s request. 

 
 Terms of payment
 
25. Vouchers can be paid for by invoice (bank transfer) or online payment (credit card, Apple Pay, Google Pay, or EPS):
Payment by invoice: The invoice amount must be transferred within one week of receiving the invoice. The vouchers only become valid after full payment has been received.
Online payment: When paying by credit card, Apple Pay, Google Pay, or EPS, the voucher becomes valid immediately and can be used right away.
Tickets can be paid either on-site or via online payment (credit card, Apple Pay, Google Pay, or EPS):
On-site payment: This payment option constitutes a binding booking to which the following cancellation conditions apply.
 
 
 Cancellation costs 
 
 26.The passenger may cancel the agreed flight appointment at any time by sending an email to info@flytandem.at.
• Cancellations made up to 4 days before the booked date are free of charge.
• For cancellations received between 3 days and 24 hours before the appointment, a cancellation fee of 50% of the booking value will be charged.
• Cancellations made within 24 hours of the appointment will incur a 100% cancellation fee. In this case, vouchers and tickets will be considered a "no-show."
 


Right to use image and film material
 
27. The passenger expressly agrees that photos and video recordings taken by FlyTandem or its pilots during or in connection with the flight may be used for advertising or similar purposes. 
 
 
 Risk information
 
28. Please note that in paragliding, even with the greatest possible care and an optimal flight process, the risk of accidents with serious injuries cannot be completely ruled out. Possible injuries include, among others, sprains, bone fractures, cervical spine contusions, spinal injuries, concussions, and in extreme cases, fatal injuries. The risk is particularly elevated during takeoff and landing, for example due to missteps, improper landings, or falls.
 

 Final provisions

29. All disputes arising from this contract are subject exclusively to Austrian law. The exclusive place of jurisdiction is the district or regional court responsible for 5101 Bergheim.  

30. If individual provisions of these Terms and Conditions are or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. In place of the invalid provision, a reasonable substitute provision shall apply that comes as close as possible to the intent of the original provision.
