General
1. FlyTandem GmbH & Co KG (hereinafter referred to as " FlyTandem ") organizes tandem paragliding flights. The flights are carried out by independent tandem pilots. The organizer and contractual partner is the company indicated on the flight ticket. This flight ticket, which must be completed in full before the tandem flight begins, also serves as an invoice for the service provided.
2. FlyTandem assumes liability for the careful selection of a suitable and safety-conscious tandem pilot. However, no liability is assumed for the performance of the tandem flight itself.
3. The transport of persons in tandem paragliders and all other services provided by FlyTandem are subject exclusively to Austrian law, in particular the provisions of the Aviation Act, as well as the following conditions.
4. Before starting the flight, the passenger (in the case of children, a legal guardian or an adult accompanying person) is obliged to read the transport contract carefully and confirm it with his or her signature. Immediately before take-off, the pilot will provide instructions on the take-off procedures. If the passenger does not understand these instructions or is unable to follow the instructions for any reason, the pilot must be informed immediately.
Insurance and liability limitations
5. Legal liability insurance is required for the tandem passenger and for the items they carry .
6. FlyTandem or the tandem pilot is only liable for damages if the damage was caused by an intentional or grossly negligent act or omission by FlyTandem , its employees or persons who are called upon to fulfil the transport contract. Liability is excluded if the carrier and its vicarious agents have taken all reasonable and necessary measures to prevent the damage or if such measures could not be taken. The carrier's liability for items carried by the tandem passenger is limited to the amount of the insurance taken out for them. Any further claims can only be made in the event of intent or gross negligence.
7. The passenger is responsible for the shock-proof packaging of any photo and film equipment and other valuables carried. These items must be secured in such a way that loss during the flight is excluded.

It is not permitted to take pointed, sharp or glass objects, weapons, pressurized containers, explosives or igniters or pyrotechnic flares on the flight.
8. FlyTandem accepts no liability for damages that occur on the way to the take-off or landing site.
9. The exclusions and limitations of liability also apply to employees, independent tandem pilots and authorized representatives of FlyTandem .
Obligation to report health impairments
10. The passenger is obliged to inform FlyTandem and the tandem pilot in good time about health conditions that could pose an increased risk to him. This includes in particular limitations in mobility, which can increase the risk of injury during take-off or landing.
11. The following must be reported in all cases: - serious accidents within the last 12 months - limitations of the musculoskeletal system - serious diseases of the heart, spine, intervertebral discs or organs, as well as high blood pressure or similar complaints that require or have required medical treatment - psychological or mental impairments such as drug addiction, impaired consciousness or similar within the last 12 months or on an ongoing basis - consumption of alcohol within the last 12 hours before the flight.
12. If there is any uncertainty about whether the passenger is fit to fly, the passenger is obliged to seek advice from FlyTandem about their suitability.
Equipment
13. The passenger undertakes to wear appropriate clothing (weatherproof, windproof and suitable for dirt), if possible sturdy shoes (above the ankles) and gloves. FlyTandem undertakes to provide a helmet and flight equipment.
Dates and implementation
14. FlyTandem offers tandem flights all year round. Restrictions may arise due to weather conditions and the operating times of the mountain railways in the respective flight areas. An online booking system is available for reserving appointments. Additional appointments can be requested and arranged using a form on the website, by phone or by email. FlyTandem is happy to help passengers select the flight area and the optimal time.
15. We expressly point out that, despite firmly agreed dates, there is no entitlement to the tandem flight being carried out if the weather conditions in the flight area do not permit this. In the event of postponements or short-term cancellations, there is no entitlement to compensation, reimbursement or reimbursement of other expenses incurred. However, the right to reschedule the flight remains. FlyTandem always endeavours to inform passengers as soon as possible about the feasibility of the flight.
16. Cancellations due to weather conditions do not require objective evidence. The subjective impression of the responsible pilot is sufficient to cancel the flight.
17. The duration of the flight depends on various weather conditions, which is why no uniform or guaranteed flight time can be guaranteed.
18. The passenger is obliged to fully follow the pilot's instructions throughout the flight, as well as during take-off and landing.
Terms of payment
19. Vouchers can be paid by invoice (bank transfer) or online payment (credit card, Apple Pay, Google Pay or EPS): Payment by invoice: The invoice amount must be transferred within one week of receipt of the invoice. The vouchers are only valid after full payment has been received. Payment by online payment: When paying by credit card, Apple Pay, Google Pay or EPS, the voucher is immediately valid and can be used straight away. Tickets can be paid for either by on-site payment or online payment (credit card, Apple Pay, Google Pay or EPS): On-site payment: This payment option represents a binding booking to which the following cancellation conditions apply.
vouchers
20. Two types of vouchers are offered:
· Tandem flight voucher : A voucher for a specific flight offer.
· Voucher : A voucher issued for a specific amount.
Both types of vouchers are considered multi-purpose vouchers. The tandem flight voucher is also just a pre-selection. Until the appointment is made, a different offer can be selected in the customer area, whereby the paid value shown on the voucher will be credited towards the exchange.
If the value of the selected offer exceeds the amount of the voucher, the customer must pay the difference. If the value of the selected offer is less than the amount of the voucher, a remaining balance will remain on the voucher. This remaining balance can be checked online in the customer area using the voucher code.
21. Validity: The paid value of the voucher is guaranteed for 30 years .
For tandem flight vouchers, there is also a price guarantee for the pre-selected offer for 1 year from the date of issue. After this period has expired, the difference between the current price of the selected offer and the value paid on the voucher must be paid when booking.
Note: Even for vouchers issued as part of discounts or marketing campaigns, the voucher value stated on the voucher applies to the price guarantee and the extension.
22. Vouchers are freely transferable. However, it is the responsibility of the voucher holder to ensure that the person to whom the voucher is transferred meets the participation requirements. The voucher value cannot be paid out in cash.
23. Vouchers from sales partners: FlyTandem accepts vouchers from selected sales partners. The passenger is responsible for checking the validity of the voucher. If a voucher is invalid (e.g. due to the insolvency of the sales partner), FlyTandem is entitled to demand the full flight price from the passenger.
24. Right of withdrawal for vouchers: According to the provisions of the Consumer Protection Act (KSchG), the buyer has the right to withdraw from the purchase within 14 days of receiving the voucher without giving any reason. To exercise the right of withdrawal, it is sufficient to return the voucher within this period.

ticket
25. A ticket, like the two types of vouchers, is essentially a multi-purpose voucher. In addition to the flight voucher, the date is already set for a ticket. The right of cancellation and exchange is generally excluded for tickets within the cancellation period. However, if a change of date or flight area is desired within the cancellation period, we will endeavour to fulfil this change request within the scope of our organizational possibilities.
If the adventure cannot be carried out due to force majeure, particularly bad weather conditions, it is possible to convert it into a voucher free of charge. This voucher entitles the holder to choose another offer from our range at a later date. If no new date or suitable offer can be found, the ticket value can be refunded at the customer's request.
Cancellation costs
26. The passenger can withdraw from the agreed event date at any time by sending an e-mail to info@flytandem.at . Cancellations made up to 4 days before the booked date are free of charge. For cancellations received between 3 days and 24 hours before the appointment, cancellation costs of 50% of the booking value will be charged. Cancellations made within 24 hours of the appointment result in cancellation costs of 100% . In this case, vouchers and tickets will be billed as a " no show".
Right to use image and film material
27. The passenger expressly agrees that photos and video recordings taken by FlyTandem or its pilots during the flight or in connection with the flight may be used for advertising or similar purposes.
Risk information
28. We would like to point out that when paragliding, even with the greatest possible care and an optimal flight course, the risk of accidents resulting in serious injuries cannot be completely ruled out. Possible injuries include sprains, broken bones, cervical spine bruises, spinal injuries, concussions and, in extreme cases, fatal injuries. There is an increased risk during take-off and landing, for example due to incorrect treading, improper landing or falls.
Final provisions
29. All disputes arising from this transport contract are subject exclusively to Austrian law. The exclusive place of jurisdiction is the district or regional court responsible for 5101 Bergheim.
30. Should individual provisions of these terms and conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by an appropriate replacement provision that comes as close as possible to the purpose of the original provision.
